Should one of the parties in a divorce die before the Judgment of Divorce is issued, the Court will lose jurisdiction of the matter and the case must be dismissed.  However, if a Judgment of Divorce was issued before the death, the Court does not lose jurisdiction over the matter, unless there is an appeal of the order for the issuance of the Judgment based on the allegation that the Court erred in finding that the marriage was irretrievably broken.  Appellate Courts do not lose jurisdiction of a matter as the result of the death of a party if the Judgment of Divorce was entered.
