Generally, property division in a divorce is nontaxable. If property is transferred pursuant to a court order, it is generally not taxed as income nor allowed as a deduction. There are ways to transfer retirement assets without incurring immediate tax liability. Some qualified retirement plans require a specific court order specifically designed to transfer assets. These orders are called Qualified Domestic Relations Orders (QDRO).
