What is collaborative divorce?

Collaborative divorce is a family law process which provides a divorcing couple with an opportunity to resolve their divorce issues without the underlying threat of going to court.  A key element in the collaborative process is the agreement between the parties and the lawyers that the lawyers will not litigate the case.  If the collaborative process fails and litigation is the only recourse, the original attorneys must withdraw and the parties must retain new lawyers.  The parties will freely disclose all relevant information and will not hide material facts.  Experts will be neutral and hired by both parties.  The collaborative divorce generally makes use of a team approach to help the parties make fully informed settlement decisions.  These consultants generally include a financial specialist and mental health professional.  Most collaborative divorces reach resolution and may be quicker, less expensive and less painful than a typical divorce.
